What is meant by "rajm" is not speaking by supposition and conjecture, but speaking by the inspiration of God, exalted. In Basa'ir al-Darajat the like of this hadith is related with three chains.

Basa'ir al-Darajat: 'Abd al-Rahim says: I heard Imam al-Baqir, peace be upon him, say: When a matter arose for the Commander of the Faithful, peace be upon him, that was not in the Book and the Sunna, he would determine it by lot and reach the truth. Then he said: O 'Abd al-Rahim, this is among the difficult matters.

Elucidation: His words "sahama" mean he learned the matter by lot; and this admits of two possibilities. 1. That what is meant is particular doubtful rulings whose determination the Lawgiver has made dependent on casting lots; and this is not a confusion in the ruling itself but in the instances of the ruling, and it in no way conflicts with the preceding reports, since casting lots too is among the rulings of the Qur'an and the Sunna. 2. That what is meant is general rulings whose derivation from the Book and the Sunna is difficult for the Imams, peace be upon them; so the Imams, peace be upon them, would derive it from the Book and the Sunna with the determination of the lot, and this was the practice of the infallible Imams, peace be upon them, since the Imam's casting of lots never goes wrong. The first possibility accords better with the principles and the other reports, although the latter possibility is more apparent.

Basa'ir al-Darajat: 'Abd al-Rahim al-Qasir related from Imam al-Baqir, peace be upon him: I heard him say: When a matter arose for 'Ali, peace be upon him, that was not in the Book and the Sunna, he gave judgement by God's inspiration. Imam al-Baqir, peace be upon him, said: This is among the difficult matters.

Basa'ir al-Darajat: Musa al-Halabi related from Imam al-Sadiq, peace be upon him, that he said: When a matter arose for 'Ali, peace be upon him, that was not in the Book and the Sunna, he gave judgement by God's inspiration and reached the truth; and this is among the difficult matters.

ط.It is plain that this is a corrupt possibility for which no proof can certainly be established. T.
20Apparently the hadith is the same as hadiths 19 and 20.
