and the companions all agree upon both reports, and there is no preference for one of the two reports — such as abundance of narration or justice — in that case the rule is the option to choose; and the proof of this is

that al-Hasan b. Jahm says: I said to Imam al-Rida, peace be upon him: Hadiths come to us from you that differ. The Imam said: Compare (present) our narrations with the Book of God and with our other narrations; if it resembles those two it is from us, and otherwise it is not from us. I said: Two trustworthy narrators relate two conflicting hadiths and we do not know which of them is true! He said: When you do not know, you are at liberty; act upon whichever you wish.

And what al-Harith b. al-Mughira related from Imam al-Sadiq, peace be upon him, that he said: When you hear a hadith from your companions and all of them are trustworthy, you are at liberty until you meet the Qa'im (may God hasten his relief) and present it to him.

Sama'a b. Mihran says: I asked Imam al-Sadiq, peace be upon him: Two hadiths have come to us, one commanding us and the other forbidding us. He said: Act upon neither of them until you meet the Imam and ask him. I said: We have no choice but to act upon one of the two. He said: Act upon the narration that differs from the Sunnis.

The Imam, peace be upon him, ordered that the narration agreeing with the Sunnis be left aside, because it may have come by way of dissimulation, whereas in a narration that differs from them there is no possibility of dissimulation.

And it is also related from them, peace be upon them, that they said: When our hadiths differ for you, take what our Shi'a are agreed upon, for there is no doubt in it.

And reports on this are many; this is not the place to set them out.

Al-Majlisi: This method of reconciliation which al-Tabarsi has set out — saying that what is meant by postponement in the report is the case where access to the Imam is possible, and that where access is impossible we have the option — is the plainest method of reconciliation. But some eminent scholars have said that the option concerns acts of worship and the postponement relates to transactions. Al-Majlisi: The postponement in the report may be taken to mean that we do not rule according to either of the two reports in particular, and this does not conflict with acting upon whichever we wish; or the postponement may be taken as recommended.
