while our houses are full of them? He answered: I say concerning them what al-Imam al-Hasan al-'Askari, peace be upon him, said concerning the books of the Banu Faddal. He said: Take what they have related and leave aside their own opinions.

I say: Al-Shaykh al-Tusi says in Kitab al-'Udda: The justice that must be observed in preferring one of two reports over the other is that the narrator should believe in the truth, should have turned away from error and falsehood, should be reliable in his religion, should keep clear of lying, and should not be suspect in what he relates. So when a narrator is opposed in belief to the root of the school and yet relates from the Imams, peace be upon them, in that case we look at what he has related: if there is a reliable way to his opposition, it is obligatory that we set his report and hadith aside; otherwise, when we have a hadith

that accords with it, acting upon it is obligatory. And if there is from the true sect neither an agreeing nor a disagreeing report, and no legal opinion of the true sect on that matter is known, acting upon it is obligatory. It is related from al-Sadiq, peace be upon him, that he said: When an event befalls you and you do not find its ruling in what has been related from us, then find its ruling from what has been related from 'Ali, peace be upon him, and act upon it.

On account of what we have said, the Shi'i community has acted upon what Hafs b. Ghiyath, Ghiyath b. Kalub, Nuh b. Darraj, al-Sakuni and others of the Sunnis have related from our Imams, peace be upon them, and have not rejected it, and no disagreement has been observed. And if the narrator was from a Shi'i group such as the Fathiyya, the Waqifiyya, the Nawusiyya and others, there is a difficulty in their narrations. If there is an indication that a narration from trustworthy men has been transmitted on the very same topic, discard the narration of these and act upon what the trustworthy have related; but if there is no contrary narration here and the community has not acted contrary to it, acting upon it is obligatory, provided the narrator is diligent in taking the narration and reliable in discharging the trust, even though he errs in the root of his belief. And on account of what we have said, the Shi'i community has acted upon the reports of the Fathiyya, such as 'Abdallah b. Bukayr and others, and upon the reports of the Waqifiyya, such as Sama'a b. Mihran, 'Ali b. Hamza, 'Uthman b. 'Isa and those who were of this group, and upon what the Banu Faddal, the Banu Sama'a, the Tatariyyun and others have related in those places where no narration to the contrary has been transmitted. As for what the exaggerators, those who are suspect, those declared weak and others relate:
